
5 States with the Strictest Fuel Storage Tank Regulations
Anyone working with above-ground storage tank (AST) regulations for fuel already knows the punchline: there is no such thing as “the” AST code. NFPA 30 and 30A give us a common technical baseline, and the federal SPCC rule (40 CFR 112) sets a nationwide floor for spill prevention, but what an installation project’s complexity and difficulty comes down to how much a state has built on top of that floor.
Some states are content to let the local fire marshal enforce NFPA 30/30A and call it a day. Others have layered on their own registration systems, certified-installer mandates, financial responsibility requirements, and inspection cycles that make a routine tank replacement feel like a multi-agency negotiation.
We pulled state statutes, administrative codes, and agency guidance to rank the five states where getting a typical fleet fuel tank permitted, installed, and kept in compliance is the hardest. California takes the top spot, as most fuel equipment veterans would guess, but the states rounding out the list may surprise you.
- California
California earns the top spot not because any single rule is uniquely severe, but because almost nowhere else in the country do so many independent regulatory layers stack on top of one another for the same tank.
The Aboveground Petroleum Storage Act (APSA), part of the Health and Safety Code, requires any facility with 1,320+ gallons of aggregate petroleum storage to prepare and implement a PE-certified SPCC Plan and file an annual Tank Facility Statement. Since 2013, CAL FIRE’s Office of the State Fire Marshal (OSFM) has provided statewide standardization, but day-to-day enforcement is delegated to roughly 80 local Certified Unified Program Agencies (CUPAs), meaning your actual compliance experience varies by county, and each one runs its own inspection cadence, fee schedule, and documentation quirks. Facilities over 10,000 gallons face APSA inspections at least every three years, and CUPAs frequently inspect more often as part of the broader Unified Program (which also folds in hazardous materials business plans, risk management, and hazardous waste generator requirements at the same site visit).
On top of APSA sits the installation layer: tank foundations, anchoring, and structural design must satisfy California’s seismic requirements, and Title 8 of the California Code of Regulations imposes its own aboveground tank installation standards that installers must reconcile with the fire code adopted locally.
Then there’s the California Air Resources Board’s Enhanced Vapor Recovery (EVR) program, Phase I and Phase II vapor recovery requirements for gasoline dispensing facilities that simply don’t exist in most states, requiring certified equipment, executive-order-specific hardware, and separate air district coordination. Retrofitting an older AST that lacks the required number of tank openings for EVR fittings is a routine and expensive headache for California fleet and retail operators.
That layered compliance environment, a single project can touch OSFM/CUPA, the local fire AHJ, Cal/OSHA, and the regional air district before a drop of fuel ever gets delivered, is what earns California the top spot, more than any one rule being uniquely severe on its own.
- Pennsylvania
Pennsylvania’s Storage Tank and Spill Prevention Act regulates AST systems down to a 250-gallon threshold, lower than most states bother to regulate at all and DEP requires registration and annual fees for every system above that line. What makes Pennsylvania genuinely distinctive is its mandatory certified-workforce model: installation, modification, removal, and inspection work must be performed by individuals holding one of roughly a dozen DEP certification categories (nine specific to ASTs alone), and companies themselves must hold a Storage Tank Company Certification. Very few states require this level of credentialing for tank work; most rely on manufacturer training or general contractor licensure.
Inspection cycles aren’t fixed calendar dates; they’re tied to a corrosion-rate calculation performed at installation, with re-inspection required at the earlier of one-quarter of the calculated remaining service life or five years, whichever comes first. The December 2018 regulatory overhaul added some of the strictest technical requirements in the country for new construction: emergency containment systems must meet strict permeability standards, permanently installed spill/overfill equipment and written shutdown procedures became mandatory, and release reporting timelines tightened to 24 hours with no grace period for any release to secondary containment, however minor. The one gap: Pennsylvania’s UST Indemnification Fund explicitly does not cover ASTs, so operators carry that financial risk privately.
- New York
New York regulates petroleum bulk storage under 6 NYCRR Part 613, and the threshold for coverage is a low 1,100 gallons of aggregate aboveground capacity, meaning even modest fleet-fueling sites end up fully in scope. Subpart 613-4 sets out AST-specific design, operation, inspection, and closure requirements, and NYSDEC mails registration renewal reminders every five years because lapses trigger violations automatically. The monthly “30-day walkthrough” visual inspection of tanks, piping, containment, leak detection, and overfill prevention equipment applies broadly by tank age or type, not just to large terminals, so a typical fleet tank is on the hook for it too.
One regulation that applies regardless of tank configuration: a 2023 amendment added a formal financial responsibility requirement (insurance, self-insurance, letter of credit, or trust fund) and a strict two-hour reporting window for any uncontained release of five gallons or more.
New York is also unusual in how many jurisdictions can weigh in on the same tank, Nassau, Suffolk, Westchester, and Cortland counties run their own overlapping sanitary code programs, and any facility in New York City has to satisfy the Department of Buildings and FDNY on top of DEC, including annual FDNY permit renewal and licensed-installer-only construction.
- Florida
Florida has one of the oldest dedicated AST programs in the country, and its geology gives the state reasons to be strict: a high water table and karst/sinkhole terrain across much of the peninsula make groundwater contamination from a tank failure a fast-moving, expensive problem. Registration is required for any tank over 550 gallons, filed 30 days before installation, with a displayed compliance placard and a modest annual renewal fee and installation or repair work requires a dedicated state contractor license, the “Pollutant Storage Systems Contractor” credential.
For a typical shop-built, double-wall AST sitting on a pad, the double-wall construction itself satisfies secondary containment and because the tank isn’t in soil contact, the corrosion- and cathodic-protection rules generally don’t come into play. What does apply broadly: a monthly visual inspection (no more than 35 days between checks) of the tank system, and continuous interstitial monitoring of the space between the tank’s two walls, checked at installation and after any repair per PEI/RP200.
Florida’s Inland Protection Trust Fund, financed by a per-barrel excise tax, backstops cleanup costs and financial responsibility obligations for registered facilities. The one wrinkle that keeps Florida from ranking higher: FDEP delegates routine compliance inspections to individual counties through “Compliance Contracts,” so the intensity and consistency of enforcement can vary depending on which county your facility sits in.
- Illinois
Illinois runs its AST program through the Office of the State Fire Marshal under the Gasoline Storage Act, with separate administrative codes and separate permit application forms for bulk storage tanks and dispensing tanks used at retail and fleet fueling sites. Submit the wrong form, and it gets bounced back. A permit application and OSFM plan review is required before installation for essentially any dispensing tank and any bulk tank over 110 gallons, covering separation distances, grounding, venting, secondary containment method, and vehicle collision protection, with construction required to meet UL 142, 2080, 2085, or 2244/2245 listings as applicable. Illinois also requires secondary containment on essentially all flammable and combustible liquid ASTs regardless of size (with a narrow Class IIIB exception), a stricter default than most states apply.
One detail that can be surprising to first-time equipment operators: Illinois requires a mandatory OSFM field inspection before the tank can be filled with product, full stop, there’s no self-certification pathway, so a scheduling delay on the state’s end can directly delay a facility opening. What keeps Illinois from ranking higher is what it doesn’t require: there’s no statewide AST registry or database (unlike the state’s own UST program), no periodic tightness or cathodic-protection testing mandate specific to ASTs, and no installer or contractor licensing requirement for AST work at all.
States Not Featured
Some states with huge petroleum storage footprints, Texas and Louisiana in particular, are notably not here, and that’s worth calling out explicitly rather than leaving to assumption. Texas’s TCEQ program (30 TAC Chapter 334, Subchapter F) is largely registration- and notification-based, with no financial responsibility requirement and no mandated periodic testing for ordinary ASTs.
Connecticut and Oregon show a similar pattern: both have demanding underground tank programs but comparatively thin aboveground-specific requirements, leaning on fire code adoption and federal SPCC rather than a dedicated state AST regime. The lesson for anyone scoping a multi-state buildout: don’t assume a state’s UST reputation, tough or lax, tells you anything about how it treats ASTs, and don’t assume a state’s toughest-sounding rule applies at fleet scale, several of the rules that shape a state’s reputation only bite at the refinery or marine-terminal end of the size spectrum.
 Why Some States Have Stricter Fuel Tank Regulations
Several factors influence why some states impose requirements beyond federal standards:
Groundwater protection. States with vulnerable drinking water resources often require enhanced leak detection and spill prevention measures.
Extreme weather risks. Coastal states subject to hurricanes, flooding, or severe storms may require additional safeguards to reduce spill risks.
Air quality concerns. Some states, particularly California, have implemented stricter vapor-control requirements to limit fuel emissions.
State regulatory authority. The EPA allows states to administer their own tank programs, and many choose to adopt requirements that exceed federal regulations.
Financial protection. Cleanup costs from fuel releases can be high. Many states require tank owners to demonstrate financial responsibility in the event of an environmental incident.
